Terms & Conditions

1. Scope

For all orders through our online shop the following terms and conditions apply.
 

2. Contractual Partner, Concluding the Contract

The purchase contract is concluded with 4little GmbH.

The presentation of products in our online shop does not constitute a legally binding offer; it is a non-binding online catalogue of products only. You can initially put our products into your shopping basket without any obligations, and correct your entries before sending your binding order at any time by using the correction tools that are provided for this purpose and which are explained in the course of the order procedure. By clicking the order button, you are placing a binding order for the goods in your shopping cart. Confirmation of receipt of the order takes place via email immediately after sending the order, and does not constitute an acceptance of the contract. We may accept your order by sending an order confirmation in a separate email or by delivering the goods within two days.

A binding contract may also be made prior to this as follows:

  • If you have chosen to pay through PayPal, the contract is entered into at the time of confirmation of your PayPal payment order.
  • If you have chosen to pay through the payment option Sofortüberweisung (immediate payment), the contract is entered into at the time of confirmation of your SOFORT AG payment order.

The language available for conclusion of the contract is German.

3. Terms of Delivery

The specified product prices do not include costs for shipping. Details on the cost of shipping can be found in the offers.

We only deliver goods via shipment. Customers cannot collect the goods themselves.
 

4. Payment

In our shop you may select from the following methods of payment:

Payment in advance
When you choose to pay in advance, we will send you our bank details in the order confirmation and deliver the goods once payment has been made.

Credit card
Your credit card will be debited at the point in time when we ship the goods to you.

PayPal
You pay the invoice amount through the online provider PayPal. You must already be registered there or you must first register, authorise with your access data, and confirm your instructions for payment to us (with the exception of guest access if applicable). Further information will be provided when placing an order.

Sofortüberweisung
We also offer immediate transfer through the Sofortüberweisung gateway. We immediately receive the credit transfer. This accelerates the entire order process. All you need is an account number, bank code, PIN and TAN. Via the secure, payment form of SOFORT AG, which is not accessible to vendors, SOFORT AG makes the transfer automatically and in real time to your online bank account. The purchase amount is transferred instantly and directly into the bank account of the merchant. When choosing the payment type ‘sofortüberweisung’ a pre-filled form opens at the end of the ordering process. This already contains our bank details. Moreover, the transfer amount and the purpose are already displayed in the form. You now need to select the country where you have your online banking account and enter the bank code. Then insert the same data as when registering for online banking (account number and PIN). Confirm your order by entering the TAN. The transaction is confirmed immediately thereafter. In principle, all Internet users can make payments via instant bank transfer as long as they have an activated online banking account with PIN/TAN features. Please note, however, that with some banks the instant bank transfer service is not yet available. Purchase-on-account via BillSAFE
If you purchase via the purchase-on-account payment method via BillSAFE, which we offer in instances of good creditworthiness, we handle the purchase-on-account via our external payment service provider BillSAFE, a service from PayPal (Europe) S.à.r.l. et Cie, P.C.A., 22–24 Boulevard Royal, L- 2449 Luxembourg. This is provided that all prior invoices have been paid. Payment takes place within 14 days following receipt of the invoice without deductions. Invoicing takes place with the delivery. If you use the payment method purchase-on-account via BillSAFE, you are immediately transferred to the BillSAFE page following conclusion of the order on our website. There, you can view the applicable BillSAFE terms of use and data protection regulations. Following successful verification of your address and creditworthiness, the payment is handled via BillSAFE, to whom we transfer our claims. In this case, you can only pay to BillSAFE with a discharging effect. Even when payment is made via BillSAFE, we remain responsible for general customer enquiries (e.g. regarding goods, delivery times, shipments), returns, complaints, cancellation policies, and cancellation notifications or for your claims for refund of any payments made. 5. Retention of Title

The goods remain our property until full payment has been received.
 

6. Transport Damages

If goods are delivered with obvious damages, please point out these defects immediately to the delivery agent, and contact us without delay. Failure to make a complaint or to contact us does not have any effect on your statutory rights or their enforcement, or on the warranty rights in particular. However, it will help us assert our own claims against the carrier and/or transport insurance.
 

7. Warranties and Guarantees

The statutory warranty rights apply. Information regarding any applicable additional guarantees and their exact terms can be found under the respective product description and on special information pages in the online shop.

8. Cancellation Policy

Start of the Right to Cancel

You have the right to withdraw from this contract within thirty days without specifying any reasons for this. The period for cancellation is thirty days from the day on which you or any third party named by you who is not the carrier was or were last in possession of the goods.

In order to exercise your right to withdraw from this contract, you must inform us (4little GmbH, Wilhelm-Schickard-Str. 7, 72124 Pliezhausen, Germany, info@4little.de, telephone: +49 (0)711-1289 6930, Fax: +49 (0)711-1289 6936) by means of a clear statement (e.g., a letter sent by post, fax or email) expressing your intention to withdraw from the contract.

You may use the cancellation form template here, but this is not compulsory.

In order to comply with the cancellation period, it is sufficient for you to send us notice that you are exercising your right of cancellation before the cancellation period has expired.

Consequences of cancellation
If you cancel the contract, we are obliged to refund all payments that we have received from you, including shipping costs (excluding additional costs that may arise if you choose a method of shipping other than the most cost-efficient standard delivery option offered by us), without delay and at the latest within fourteen days of receipt of your notice of cancellation. The repayment will be made using the same payment method as used for the original transaction unless otherwise explicitly agreed with you; under no circumstances will you be charged fees for this repayment. We may withhold the refund until the items have been returned to us or until you have provided evidence that you have shipped the goods, whichever is earlier.

You must send back or deliver the merchandise promptly, and in any case no later than fourteen days from the day you notify us of your cancellation of this contract, to us or to 4little – Logistic Center Kids Fashion Group, Johann-Friedrich-Diehm-Strasse 2, 36341 Lauterbach. The deadline will be deemed to have been observed if you send the items before the thirty-day deadline has expired. You will bear the direct costs of returning the goods. You are responsible for any decrease in the value of the merchandise only if such decrease in value is the result of handling it in a manner that was not necessary in order to examine the quality, features, and functions of the merchandise.

The right of cancellation does not apply to the following contracts:
Contracts for the delivery of goods which are not prefabricated and which the consumer normally makes an individual choice or decision in their manufacture or which are clearly tailored to the personal needs of the consumer;
